Description of Binding Agreement
This document serves as a binding agreement between the homeowner, business owner, and/or any person/s allowed to make decisions concerning the property, also identified as ‘Client’ and SoftWash Kingdom, its owners, employees, and subcontractors, also identified as "Company," for the execution of services in exchange for payment for residential and/or commercial cleaning services. These services include pressure washing and non-pressure washing services. The services that SoftWash Kingdom provides to the ‘Client’ are subject to the following ‘Terms and Conditions’, and we reserve the right to update these ‘Terms and Conditions’ at any time.
Acceptance of Terms
By accepting this estimate from SoftWash Kingdom, the ‘Client’ enters an agreement with all ‘Terms and Conditions’ set by the ‘Company’.
Authorization
The ‘Client’ agrees to allow SoftWash Kingdom, the ‘Company’, on the property to perform services that have been agreed upon within the contract as well as any services that may be related to the performance of the agreed-upon services. The ‘Client’ understands that the completion of service has no set timeframe and may require several visits to the property. Additionally, the ‘Client’ understands that unforeseen circumstances such as bad weather, equipment failure, or other calamities may require the scheduled service to be postponed. The ‘Company’ will attempt to accommodate the ‘Client’ as quickly as possible and will reschedule at the earliest convenience. By agreeing to the ‘Terms and Conditions’ the ‘Client’ allows the ‘Company’ permission to visit the property with little to no notice before and/or after the service date to assess performance requirements and verify completion of services rendered.
Water usage
The ‘Client’ agrees to allow SoftWash Kingdom access and use of their water source via a tap or spigot, which will be turned on and easily accessible on the service date. If the water source is sourced in an area with low water pressure or volume, the ‘Client’ agrees to cease all water consumption in all areas that directly affect pressure, including faucets, dishwashers, washing machines, outdoor sprinkler systems etc. for the duration of service. The ‘Client’ understands there will be no compensation, either directly or by credit to account, for the use of their water as the estimate assumes the use of water provided by the ‘Client’.
Electric Usage
The ‘Client’ will provide SoftWash Kingdom with access to adequate and necessary power sources on site as well as the permission to use this power source. The ‘Client; understands there will be no compensation, either directly or by credit to account, for the use of their power as the estimate assumes its use provided by the ‘Client’.
Acknowledgment of Risks and Release of Liability
SoftWash Kingdom technicians are trained to use all necessary equipment including cleaning products and chemicals. These technicians take extreme precautions not to cause harm and/or cause damage to property. Safe cleaning techniques are the standard of the ‘Company’ and these standards include the consistent use of the least aggressive methods to achieve the desired results of the ‘Client’. The ‘Client’ understands that even with numerous preventative measures in place, damage can still occur for various reasons. These reasons include, but are not limited to, poor maintenance by the ‘Client’, including neglect of the property. Additionally, the ‘Client’ understands that worn or degraded materials, materials that are at the end of their useful life or lower grade building materials may sometimes fail to withstand proper cleaning techniques. To avoid preventable damage, the client should have routine maintenance following the manufacturer's recommendation. Before the date of service, it is the responsibility of the ‘Client’ to address any areas of concern to ensure the property is sealed watertight and clear of any potential failing parts, fixtures, or structures. The ‘Client’ assumes all risk and responsibility for any damage caused due to flawed, inadequate, improperly maintained, broken, and aged materials as well as any damage caused by inadequate preparation before the date of service. The ‘Client’ releases SoftWash Kingdom of any liability concerning property damage unless it was directly caused by gross negligence, willful misconduct, or operator error.
Inspection and Estimating
On the date of inspection, a representative of SoftWash Kingdom will walk the property and document any remarkable findings. These documented items will include any needed services as well as a written and/or verbal explanation of why they are necessary. An estimate form will be provided to the potential ‘Client’ for acceptance or rejection unless the “Client” verbally accepts an estimate and enters a contractual agreement. During the inspection, as much as possible, the ‘Company’ will note any preexisting conditions that the ‘Client’ should be made aware of. Photos of preexisting damages will be sent to the ‘Client’ whenever possible. Under certain circumstances the ‘Client’ will need to acknowledge and confirm preexisting damages before the ‘Company’ will proceed with any service. If damage is found at the time of service, the ‘Company’ will cease all attempts at service until the ‘Client’ can see the damage and acknowledge its existence.
Plants and Landscaping
The ‘Client’ understands that SoftWash Kingdom practices a set of procedures and precautionary measures to ensure the safety of all plant life surrounding the immediate areas to be cleaned. The ‘Client’ is responsible for disclosing any special information concerning weak or compromised vegetation that could help aid in the process of protecting plant life and/or vegetation. Although all measures are taken to avoid any adverse effects on plant life, the ‘Client’ understands that there are circumstances that at times make it impossible to perform a cleaning service and avoid all unknown minor damage. The ‘Client’ accepts all responsibility for damaged plant life and vegetation unless it is due to gross negligence, willful misconduct, or operator error.
Oxidation and Fading
Houses that endure prolonged exposure to the sun or that have not been adequately maintained may be susceptible to oxidation and/or visible forms of wear or fading. Signs of oxidation can be seen as a chalky white powder or a white film on siding or roofing. Fading can also occur and be seen as a mellowing of the original color. The ‘Client’ understands that oxidation and fading may only be noticeable after cleaning due to being previously hidden by the recently removed blemishes. The ‘Client’ understands that additional services may need to be performed at an additional fee. The ‘Client’ understands that in all circumstances, SoftWash Kingdom is being compensated for a specific service and not a specific result.
Window Cleaning and Window Screens
The ‘Client’ understands that basic window cleaning is included with the soft washing of a structure with windows. Basic window cleaning is a byproduct of the structure cleaning and will eliminate visible debris, but spots may occur due to hard water or heavily soiled window units. The ‘Client’ understands that for a detailed streak-free window cleaning they must add a Window Cleaning Service that includes the use of a purified water-fed-pole to remove spots and streaks. Concerning window screens the ‘Client’ understands that some window screens are delicate and brittle due to age and wear. The ‘Company’ will use extreme precautions when soft washing. The ‘Client’ is responsible for any window or window screen damage due to wear, tear, and deterioration. When the ‘Client’ chooses not to add a Window Cleaning Service with a soft wash, SoftWash Kingdom will not remove window screens.
Responsibilities of the ‘Client’ on The Day of Service:
- Please have a water spigot or outdoor tap activated and easily accessible.
- Please have an area directly in front of the property available for the wash truck and trailer.
- During a house soft wash and/or window cleaning, please have all windows & doors shut tightly.
- Please have all pets inside before and during cleaning.
- Please have all pet droppings cleared from the premises. It becomes an issue of sanitation when we drag our hoses through the waste material. SoftWash Kingdom will reschedule if waste is present.
- Please clear all items from all areas that are to be cleaned. Remove flags, doormats, vehicles, furniture, potted plants, clocks, wall art, sensitive materials, or any potential clutter. The moving of items is not included in any estimate and due to planning the service will have to be rescheduled if the areas are not cleared.
- The ‘Company” suggests the ‘Client’ utilize their property’s safety switch or circuit breaker to shut off power to any exterior outlets, light fixtures, or electrically powered features. This is especially important for outlets that are not covered with exterior covers.
- The ‘Client’ understands that the SoftWash Kingdom strives to be as efficient and proficient as possible. We are proud to be respectful, courteous, and professional. Respect is expected of the ‘Client’. Please understand that SoftWash Kingdom refuses to service any ‘Client’ that behaves disrespectfully to any of our team members.
Important Items:
- The ‘Client’ understands there is a $50.00 cancellation fee if notice is not received within 48 hours of service.
- The ‘Client’ understands there is a $100.00 trip fee if SoftWash Kingdom arrives and must reschedule due to the ‘Client’ failing to prepare for the Day of Service as outlined in ‘Responsibilities of the ‘Client’ on the Day of Service’.
- SoftWash Kingdom is not responsible for water intrusion. While every effort is made to prevent water intrusion, bad seals around windows and doors and cracks in concrete foundations are unknown to the ‘Company’ and make water intrusion unavoidable.
- SoftWash Kingdom strives for excellence and performs every task with a hope for perfection. Perfection is not always the case. Some stains are too deep, and some material is too far gone. The ‘Client’ understands that they are paying for a specific service and not a specific result.
- Please notify the ‘Company’ if any surfaces or materials on or near the areas to be cleaned would become damaged if touched by certain chemicals. The air moves water droplets, and we cannot always control where they move to. We can, however, suggest remedies if we are made aware of the potential hazards. SoftWash Kingdom will not be held responsible for damages due to withheld information.
- The ‘Client’ understands that some cleaning solutions provide ‘Delayed Results’, meaning that the growth is dead, but may not be fully removed until the growth begins to deteriorate and is wash or blown away by weather conditions.
